Last updated: 12 October 2026

These terms apply to your use of Shipping-Containers.co.nz and its quote service. By using the website or sending a request, you agree to them. If you do not agree, please do not use the website.

1. Definitions

  • “We”, “us” and “our” mean Containerbasis Pty Ltd (ACN 684 190 145), the operator of the website.
  • “Platform” means the website Shipping-Containers.co.nz, its quote form and related emails.
  • “You” means the person using the platform, and the business you act for if you use it for a business.
  • “Supplier” means an independent business that sells, hires, modifies or transports containers and receives requests through the platform.
  • “Request” means the information you send us to obtain quotes.
  • “Goods and services” means containers, accessories, modifications, hire, delivery and related services offered by a supplier.
  • “Consumer” and “in trade” have the meanings given in the Consumer Guarantees Act 1993.

2. Our role as a marketplace

Shipping-Containers.co.nz is an independent quote marketplace. We do not own stock, depots or trucks, and we do not sell, hire or deliver containers ourselves. We pass your request to suppliers who service your area, and they quote you directly. More about how the service works is on our about us page.

Any contract for goods or services is between you and the supplier. We are not a party to it and we are not the supplier’s agent. We do not guarantee that a supplier will quote, supply, deliver or perform. We take reasonable care in choosing the suppliers we pass requests to, but we do not control their prices, availability, terms or conduct.

The information on the platform, including guides on consent, delivery, prices and container condition, is general information. It is not legal, engineering or building advice. Check the rules that apply to your property with your council and, where needed, a qualified professional.

3. Requests, quotes and orders

Sending a request through our quote form is not an order and does not commit you to buy or hire anything. You agree that we may share your request with suppliers as described in our privacy policy.

Quotes come from suppliers. Each quote is an offer from that supplier on its own terms and is valid for the period it states. A contract is formed only when you accept a supplier’s quote and the supplier confirms the order. Read the supplier’s terms before you accept, especially on payment, delivery, cancellation and container grade.

You must give accurate and complete information in your request, including the delivery address and site access. If you include another person’s contact details, you must have their permission to share them.

4. Prices and GST

Suppliers set their own prices and payment terms. We do not usually take payment for goods or services. If we ever collect a payment, we will tell you clearly before you pay.

GST in New Zealand is 15%. Check whether a quote includes or excludes GST, and whether it includes delivery, HIAB or crane charges, site visits and any surcharges.

Prices shown on the platform, including the NZ price index, are published market data collected for information. They are not offers, and neither we nor any supplier guarantee them.

5. Delivery and site conditions

Delivery is arranged by the supplier or its transport operator. Delivery dates are estimates unless the supplier agrees otherwise in writing.

Unless your agreement with the supplier says otherwise, you are responsible for:

  • giving correct details of the site, including access width, slope, ground conditions, overhead power lines, trees and gates
  • providing a safe, firm and level place for the container and for the truck to work
  • obtaining any council permits, consents or road use approvals that the placement or use of the container needs
  • being present, or arranging for someone to be present, when the supplier needs it

If the truck cannot safely reach the site or place the container because of site conditions, the supplier may charge for a wasted trip or extra work under its own terms.

6. Condition of goods

Used containers show signs of their working life, such as dents, surface rust, repairs, marks and faded paint. New and one-trip containers can have minor handling marks. Container grades are not standardised across New Zealand suppliers, so ask each supplier exactly what its grade means and inspect the container where you can. Photos on the platform illustrate container types and are not photos of the unit you will receive.

7. Cancellations

Cancellations, changes, returns and refunds are governed by the supplier’s terms and by consumer law. If you need to cancel an order, contact the supplier directly as soon as possible. You can withdraw a request from our quote process at any time by emailing us.

8. Consumer law

Nothing in these terms limits any right you have under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA) that cannot lawfully be excluded.

If you are a consumer, the CGA gives you guarantees from the supplier, including that goods are of acceptable quality, fit for any purpose you made known, match their description and are delivered on time and in good condition, and that services are carried out with reasonable care and skill. For used containers, acceptable quality is judged against matters such as age, price and how the container was described. Claims under these guarantees are made against the supplier that sold or hired the goods to you.

The FTA prohibits misleading or deceptive conduct and false representations, including about the nature, quality, price or suitability of goods. We aim to describe containers, prices and processes accurately, and we expect suppliers to do the same.

If you use the platform for the purposes of a business, the CGA can be excluded only where both parties are in trade, the goods or services are supplied and acquired in trade, the agreement is in writing, and it is fair and reasonable for the parties to be bound by it, as set out in section 43 of the CGA. Where all of those conditions are met, you and we agree that the CGA does not apply to the platform and our services. A supplier that wants to contract out of the CGA with a business customer must do so in its own written terms.

9. Disclaimers and limitation of liability

To the extent permitted by New Zealand law:

  • the platform is provided as is and as available, and we do not promise that it will be uninterrupted or error-free, or that every page is current
  • we are not liable for the acts, omissions, goods, services, prices or delays of any supplier, or for any contract between you and a supplier
  • we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or opportunity, arising from your use of the platform
  • our total liability to you for all claims relating to the platform is limited to NZ$100

These limits do not apply where the law does not allow them, including rights under the CGA that cannot be excluded for consumers, and they do not limit our liability for fraud or wilful misconduct.

10. Indemnity

To the extent permitted by law, you agree to indemnify Containerbasis Pty Ltd against claims, losses and reasonable costs arising from information you knowingly give falsely in a request, from your breach of these terms or from your misuse of the platform. This does not apply to the extent a loss is caused by our own breach or negligence.

11. Intellectual property

The text, guides, price index, images, design and brand on the platform belong to us or our licensors. You may view and print pages for your own use and share links to them. You may not copy, republish or scrape content for commercial use without our written permission.

12. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, such as severe weather, earthquakes, floods, pandemics, strikes, port or road closures, internet or hosting outages and government action.

13. Severability

If any part of these terms is found invalid or unenforceable, that part is limited or removed to the minimum extent needed, and the rest of the terms continue to apply.

14. Governing law

These terms are governed by the laws of New Zealand. You and we submit to the jurisdiction of the courts of New Zealand. Claims within its jurisdiction may also be taken to the Disputes Tribunal.

15. Changes to these terms

We may change these terms from time to time. The date at the top shows the current version. Changes apply from the date they are published and do not affect a request you sent before then.

16. Contact

Questions about these terms can be sent to hello@shipping-containers.co.nz or through our contact page. Shipping-Containers.co.nz is operated by Containerbasis Pty Ltd (ACN 684 190 145), New Farm, Brisbane, Queensland, Australia.
